Terms of sale
The terms you agree to when you place an order — pricing, availability, safety, warranties and liability.
1. Who you are contracting with
These terms govern every sale made through zirconsupply.store. The seller is Zircon LLC, trading as
Zircon Supply Co., 3275 S Stonegate Cir #104, New Berlin, WI 53151. Placing an order means you accept these terms.
2. Orders and acceptance
Your order is an offer to buy. A contract is formed when we dispatch the goods, not when the website
confirms receipt of the order. If we cannot supply something, we will email you with the option to wait,
substitute or cancel, and refund in full if you cancel.
3. Pricing and errors
Prices are in US dollars and exclude sales tax, which is applied at checkout where it is due. We try
hard to price correctly, but if an obvious pricing or description error appears — a kiln at the price of
a kiln shelf, for instance — we will contact you before charging or shipping, and you may confirm at the
corrected price or cancel for a full refund.
4. Availability
Stock shown is what is on our racking at the time the page is generated. Two buyers can occasionally
take the last of something within minutes of each other; when that happens we tell you the same day.
5. Delivery and risk
Shipping terms, freight handling and transit damage are set out on the
shipping and freight page, which forms part of these terms. Risk passes to you
on delivery. Title passes when payment has cleared in full.
6. Returns
Returns and cancellations are governed by the returns and cancellations page,
which also forms part of these terms.
7. Materials safety — read this one
Ceramic materials are industrial materials. Many contain crystalline silica, which is
hazardous when inhaled as dust. Some colourants, frits and stains contain barium, lithium, manganese,
cobalt, chrome or nickel compounds that are toxic if inhaled or ingested. Safety data sheets are supplied
with every hazardous material and are available on request before you buy.
You are responsible for handling, storing, mixing, firing and disposing of these materials safely and
in accordance with the manufacturer’s safety data sheet and applicable law — including respiratory
protection, ventilation, wet cleaning rather than sweeping, and keeping materials away from food areas
and from children. We do not advise on the food safety of a finished glaze surface: a glaze recipe,
application thickness and firing schedule are all yours, and any piece intended to hold food or drink
should be independently leach-tested before it is used or sold.
8. Kilns and electrical installation
Electric kilns must be installed and wired by a licensed electrician to the manufacturer’s
specification and to local code, on a dedicated circuit of the correct rating, with adequate clearance
and ventilation. We supply equipment; we do not inspect premises and we do not certify installations.
An installation that does not meet the manufacturer’s specification will usually void the manufacturer’s
warranty as well.
9. Warranties
Equipment carries the manufacturer’s warranty, which passes to you as the buyer; we will help you
claim under it. Materials are warranted to be as described and fit for their stated firing range when
stored and used as directed. Beyond that, and to the extent the law allows, goods are supplied without
further warranty.
10. Limitation of liability
Our liability for any order is limited to the amount you paid for that order. We are not liable for
indirect or consequential loss — including lost studio time, lost kiln loads, lost sales or the value of
work damaged in a firing. Nothing in these terms limits liability for death or personal injury caused by
negligence, for fraud, or for anything else that cannot be limited by law.
11. Acceptable use
Do not use this site to attempt fraudulent orders, to scrape prices at a rate that degrades it for
others, or to place orders you do not intend to pay for. We may refuse or cancel an order, and refund it,
where we reasonably suspect fraud or card misuse.
12. Governing law
These terms are governed by the laws of the State of Wisconsin, and the courts of Wisconsin have
exclusive jurisdiction over any dispute, without affecting any consumer right you have to bring a claim
in your own state.
